In any given society, road traffic laws are made. And are very essential for the driver as well as other road users. FRSC Establishment/Act 2007 is one of the traffic related laws and regulations that is in place to checkmate drivers excesses. However, these laws usually have sanctions to serve as deterrent to other perpetrators or intending offenders.
The followings are the highlights relating to Part III- Offences and Miscellaneous Provisions: Section 20-26 of the FRSC Establishment/Act 2007
Part III: Section 20-36 Of The FRSC Establishment/Act 2007
A person who causes the death of another person. By driving of a motor vehicle on a highway dangerously or recklessly. Imprisonment for a term not exceeding 7 years
Subsection (1) Person who drives a motor vehicle on a highway dangerously or recklessly shall be guilty of an offence and liable on conviction of #50,000(fifty thousand naira) fine, 2 years imprisonment or both.
Subsection (2) If upon the trial of a person for an offence against section 20, the court is not satisfied that the person driving was the cause of the death but is satisfied that he is guilty of dangerous/reckless driving, the court may convict the person accordingly
A person, who drives a motor vehicle on a highway under the influence of intoxicating drugs or alcohol above 0.5mgs per liter of alcohol or to such an extent as to be incapable of having proper control of such vehicle, shall be guilty of an offence and be liable on conviction to a fine of #5,000(five thousand naira), 2 years imprisonment or both
Subsection (1) A person shall not drive on a highway a motor vehicle of any class or description unless he is the holder of a valid driver’s license
Subsection (2) A person who acts in contravention of subsection (1) of this section shall be guilty of an offence and liable on conviction to a #10,000 fine
A person who while driving on a highway is in possession of a forged driver’s license or documents shall be guilty of an offence and be liable on conviction to a fine of #20,000(twenty thousand naira) fine
Subsection (1) In the case of accident on the highway the driver or person involved shall immediately or as soon as practicable report to the nearest FRSC office or police station for appropriate action
Section (2) Any person who fails to comply with subsection (1) of this section shall be guilty of an offence and be liable on conviction to a fine of #20,000.
Section (1) A driver shall not drive a vehicle on a highway with a load exceeding a capacity prescribed for that class or type of vehicle .
Subsection (2) A person who drives a vehicle in contravention of Subsection (1) of this section commits an offence. And is liable on conviction to #10,000(ten thousand naira) fine.
